Terms of Service

1. Agreement to Terms

By creating an account or using eBook Narrator ("the Service"), operated by Scriptura Software LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. What We Do

eBook Narrator is a web-based platform that helps authors transform written manuscripts into audiobooks using AI-powered text-to-speech technology. You upload your manuscript, configure voices for your characters, and we generate professional-quality audio files you can use however you like.

3. Your Account

You must provide accurate information when creating your account and keep your login credentials secure. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, please contact us immediately.

4. Your Content — You Own It

You retain full ownership of everything you upload and everything we generate for you. Your manuscripts, your audiobooks, your characters — they're yours.

By uploading content, you grant us a limited, temporary license to process it through our AI systems solely to produce your audiobook. We do not use your content for AI training, sell it to third parties, or claim any rights to it. When you delete a project, we delete the associated files.

5. Acceptable Use

You agree to use the Service responsibly. Specifically, you agree not to:

• Upload content you don't have the rights to
• Upload content that is illegal, abusive, or violates others' rights
• Attempt to reverse-engineer, exploit, or interfere with the Service
• Use the Service to generate misleading deepfake audio or impersonate real people without their consent
• Resell access to the Service or share your account

We reserve the right to suspend accounts that violate these guidelines.

6. Plans, Tokens & Payments

The Service offers free and paid subscription plans, as well as one-time token bundles. Here's how it works:

• Monthly tokens are included with your plan and reset each billing cycle. Unused monthly tokens roll over up to your plan's cap.
• Purchased tokens (one-time bundles) never expire and are used after your monthly tokens.
• Token cost varies based on the voice quality tier you choose (Good, Great, or Best).
• Subscriptions are billed monthly through Stripe. You may cancel anytime from your Settings page or Stripe billing portal — your access continues through the end of the billing period.
• Refunds: Unused purchased token bundles may be refunded within 7 days of purchase if no tokens from that bundle have been consumed. Monthly subscription fees are non-refundable, but you can cancel to prevent future charges.

7. AI-Generated Audio

The audio we generate uses third-party AI text-to-speech technology (currently OpenAI). While we strive for high quality, AI-generated audio may occasionally contain mispronunciations, pacing inconsistencies, or other imperfections. You should review your audiobook before distributing it.

You are free to distribute, sell, or publish the audiobooks you create through eBook Narrator on platforms like Audible, ACX, or anywhere else. The generated audio is yours to commercialize.

8. Service Availability

We work hard to keep eBook Narrator available and reliable, but we cannot guarantee 100% uptime. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for the actions of third-party services (Stripe, OpenAI, AWS) that we integrate with

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email or through the Service. Your continued use after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Montana, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Montana.
